Annulment (Declaration of Invalidity)
Terminology
Pre-Divorce
Colorado
Colorado does have annulments, but it's narrow and rare. It's formally called a "Declaration of Invalidity of Marriage" (C.R.S. § 14-10-111), and it says the marriage was never validly formed in the first place, different from a divorce, which ends a valid marriage. It's available only in specific situations, such as one spouse lacking the mental capacity to consent, a marriage induced by fraud or duress, a party being underage without proper consent, bigamy, or other grounds the statute lists, and there are time limits to act. Most people who think they want an "annulment" actually need a dissolution. Because the grounds are technical and must be proven, this is one to discuss with an attorney rather than assume.
