Who Gets the Pet
Process
During Divorce
Colorado
Colorado law treats pets as property.
As much as your dog or cat feels like family, Colorado courts legally classify pets as personal property, like a car or furniture, and divide them as part of the marital estate. There's no built-in "best interest of the pet" standard and no court-ordered pet visitation. A pet you owned before the marriage, or received as a gift or inheritance, is generally your separate property; a pet the couple got together during the marriage is marital property, which in a contested case usually means one person keeps it.
The reliable path is to settle it yourselves. Because Colorado lets couples write their own separation agreement, you can build in shared time or a sharing schedule that a judge would have no obligation to order.
