Two assets with the same value can be worth different amounts after taxes, and divorcing couples may trade themselves into a bad deal by ignoring this. A $100,000 traditional (pre-tax) retirement account is worth less than $100,000 in a savings account, because the retirement money gets taxed on withdrawal. Capital gains lurking in appreciated stock or a house also affect real value. Other tax angles to flag: who claims the children as dependents, the tax treatment of a home sale, and the fact that under current federal law (and Colorado's maintenance formula) maintenance is generally not tax-deductible to the payer or taxable as income to the recipient for orders entered after 2018. Run potential agreements past a CPA or a divorce financial analyst before you sign.
