Dividing the Debts
Advice
During Divorce
Colorado
Debt gets divided like property in Colorado, equitably. Debts taken on during the marriage for marital purposes are generally marital, regardless of whose name is on them, and get allocated as part of a fair overall division. The same warning as with the house applies to all joint debt: creditors are not bound by your decree. If the decree assigns a joint credit card to your spouse and they don't pay, the creditor can still come after you. Wherever possible, pay off joint debts as part of the settlement (even if it means selling something), close joint accounts, and refinance shared loans into one name. A "hold harmless" clause gives you a claim against your ex if they default, but it doesn't stop the creditor from calling you first.
