Who Gets the Kids?
Advice
During Divorce
Colorado
There's no default winner. Colorado decides parenting on the best interests of the child, with no preference for mothers or fathers, and it uses "allocation of parental responsibilities" (parenting time plus decision-making) rather than "custody." In practice, courts in much of the state lean toward keeping both fit parents substantially involved, often with shared decision-making and significant parenting time for each. What helps your case is being a stable, involved parent who supports the child's relationship with the other parent. What hurts it is trying to cut the other parent out or weaponizing the kids. Colorado has no fixed age at which a child chooses where they live; a mature child's wishes are considered but never controlling.
