SafetyMediationUncontested
In a low-conflict, non-abusive marriage, telling your spouse before filing can set a more cooperative tone and open the door to mediation, a joint co-petition, or an uncontested (‘no fighting’) process. Being served out of the blue can start the process off as a war. If you have any concern that your spouse will react by hiding assets, draining accounts, becoming abusive, or taking the kids, the advice might be clearer: prepare quietly first (organize all your documents, your own account, a consultation with an attorney, and create a safety plan) and coordinate timing with your attorney.
