FilingInjunctionSafety
There's no automatic legal advantage to filing first in Colorado; being the petitioner doesn't make you more likely to "win" parenting or property. Filing first has minor practical perks: you choose the timing (so you can prepare first), and filing plus service triggers the Automatic Temporary Injunction that freezes asset-shuffling. The bigger reasons to file sooner are situational, such as if you fear your spouse will hide assets, drain accounts, or take the kids out of state; if there's abuse, safety drives the timing. Otherwise, preparation matters more than racing to the courthouse and filing jointly as co-petitioners is often the friendliest path of all.
