Step 3 - The Response (21 Days)
Process
During Divorce
Colorado
FilingTimelineOut-of-State
After being served, the respondent has 21 days (35 if served outside Colorado) to file a Response. Colorado divorce isn't a "win/lose" lawsuit, so a response mostly tells the court whether the respondent agrees the marriage is irretrievably broken and where the parties stand on the issues. A spouse who ignores the case risks a default, where the court can proceed without them, but even then the court still won't finalize before the 91-day mark and still scrutinizes the property division, support orders, and parenting orders for the children's benefit. There's no advantage to refusing to participate.
